The phrase is attested, apparently for the first time, in Gustav Radbruch’s influential 1914 book Grundzüge der Rechtsphilosophie (see quotations below). Radbruch attributes it to Wilhelm Busch, but it has not been found in Busch’s writings. So it was probably misattributed and may eventually be of popular origin. The 1914 attestation definitely disproves later attributions to writer Bertolt Brecht and cabaret artist Werner Kroll. One or both of these may have contributed to popularising the phrase, however.",
